What defences are available for failing a sports drug test?
Failing a routine drug test is devastating for an athlete and puts their career and professional reputation at risk. If you are required to have a drugs test, you will be notified by a Doping Control Officer (DCO) or a Witnessing Chaperone, who must show you their identification and formally advise you that you have been selected. You will need to report with the Chaperone or DCO to the Doping Control Station. You could be asked to provide either a blood or urine sample. If a blood sample is requested, there will be a Blood Collection Officer (BCO) in attendance.
If you fail a drug test, it may be because the supply of blood or urine provided was contaminated either deliberately or accidentally. Athletes have also overturned a positive drug test on grounds the testing was wrongly conducted. Because the equipment used by anti-doping testers is now so advanced, therefore it can pick up the tiniest traces of a substance, accidentally coming into contact with a banned substance can result in a failed test. For example, American Olympic Gil Roberts successfully defended a failed drug test for probenecid. A minuscule amount was discovered in his system, which Roberts claimed has come from kissing his girlfriend after she had taken an obsolete medicine called moxylong, which contains probenecid, to help cure a sinus infection which she caught whilst on holiday in India. The Court of Arbitration for Sport ruled in Robert’s favour.

Often, this results in the matter being concluded before being brought to trial. Therefore, it is essential that I become involved at the earliest possible moment so I can do everything possible to manage the situation and avoid you being exposed to career-damaging negative publicity.

I have assisted agents and clubs negotiate successfully to bring key players onto their teams. By working with UK and international legal representatives, I can advise on negotiation strategy, and ensure all the legal elements of the transfer between clubs is taken care of.
