Civil Fraud FAQs

What is the difference between criminal fraud and civil fraud?

Criminal fraud involves the police or an enforcement body such as the SFO, FCA, or HMRC investigating a person or business for fraudulent activity. Fraud is a criminal offence under various Acts of Parliament, including the Fraud Act 2004 and the Theft Act 1968. If you are convicted of fraud, you could be fined a large amount, disqualified from acting as a company director, and/or sent to prison. To gain a conviction, the Prosecution must prove beyond reasonable doubt that you are guilty.

Civil fraud claims are brought by claimants who believe they have suffered loss or damage due to fraudulent conduct. The standard of proof, ‘on the balance of probabilities’, is less than that required for a criminal conviction. If a Claimant wins a civil fraud case, the Court will normally award them compensation/damages. Private actions can also be brought to confiscate or recover property/assets acquired through criminal conduct.

Can I face criminal prosecution if a civil fraud claim is brought against me?

Yes, which is why you must contact me as quickly as possible. Criminal prosecution can be brought before or after civil proceedings. And unless you face a real risk of serious prejudice, criminal and civil proceedings can run simultaneously. What is a Freezing Order?

A Freezing Order is an interim injunction issued by the Court to prevent assets from being dealt with or disposed of by the Respondent. Assets that can be frozen, include bank accounts, shares, investments, land, and property such as art, cars etc. If you are bringing a civil fraud claim, speed is essential. Freezing Orders can be hard to obtain. I have the experience required to swiftly gather the necessary evidence to convince the Court there is a real risk of assets being dissipated if a Freezing Order is not granted. And if you have discovered a Freezing Order has been made against you, contact me immediately so I can prepare to challenge the injunction.
