What is Section 37 of the Health and Safety at Work act?
Section 37 of the Health and Safety at Work act relates directly to the liability of directors, managers and senior officers in company health and safety offences. If one of these senior staff members are found to be negligent or offences were committed with consent then the individual can also be tried alongside the corporate body. This can lead to a number of outcomes such as fines, imprisonment and complete disqualification.
This section of the act specifically focuses on holding leadership accountable and emphasises that safety works from the top down, with those at the top holding a higher amount of responsibility.
